
Refusal to Aid Police Under Attack: Understanding the Legal Penalties
Refusing to assist police officers under attack is a punishable offense in Nigeria. According to Section 99 of the Nigeria Police Act 2020, if an individual neglects or refuses to aid a police officer who is being assaulted or is in danger of being assaulted while performing their duties, that person commits an offense. Upon conviction, the penalty can be a fine of ₦100,000, imprisonment for up to three months, or both.
Additionally, Section 98 of the same Act stipulates that assaulting, obstructing, or resisting a police officer in the discharge of their duty, or inciting others to do so, is an offense punishable by a fine of ₦500,000, imprisonment for six months, or both.
Furthermore, Section 197 of the Criminal Code Act states that obstructing or resisting any public officer while they are performing their lawful duties is a misdemeanor, punishable by up to two years of imprisonment.
