Privacy Lawsuit: Falana Seeks $5 Million from Meta

Renowned human rights lawyer and Senior Advocate of Nigeria, Femi Falana, has filed a $5 million lawsuit against Meta Platforms Inc., the parent company of Facebook, alleging an invasion of his privacy. The suit, lodged before a Lagos High Court, centers on a video published on Facebook under the title “AfriCare Health Center,” which falsely claims that Falana suffered from prostatitis for over 16 years.

The video includes his name, image, and purported voice, which Falana contends is a violation of his fundamental right to privacy as guaranteed by Section 37 of the Nigerian Constitution and the Nigeria Data Protection Act 2023.

In his legal action, Falana seeks a declaration that Meta’s publication constitutes an invasion of his privacy. He is requesting an order mandating Meta to remove the misleading video from Facebook and cease any further dissemination. Additionally, Falana is demanding $5 million in general damages for the emotional, psychological, and reputational harm caused by the publication.

Falana argues that Meta failed to verify the authenticity of the content before allowing its publication and widespread circulation. He accuses the company of acting recklessly by permitting unverified health-related claims that could damage his public image. Furthermore, he alleges that Meta benefits financially from such misleading posts through advertising revenue, exacerbating its negligence.
