
Nnamdi Kanu’s Trial Resumes: Justice Nyako’s Role in Focus
On February 10, 2025, Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), appeared before Justice Binta Nyako at the Federal High Court in Abuja for the resumption of his trial on charges including terrorism and treasonable felony. This session marked a significant development, as Justice Nyako had previously recused herself from the case on September 24, 2024, following an oral application by Mr. Kanu expressing a lack of confidence in her impartiality.
Despite her earlier recusal, the Chief Judge of the Federal High Court, Justice John Tsoho, reassigned the case to Justice Nyako, stating that Mr. Kanu’s request for recusal should have been submitted formally through a motion on notice.
During the recent court session, Mr. Kanu’s legal team, led by Aloy Ejimakor, reiterated their objection to Justice Nyako presiding over the trial, citing her prior recusal and questioning the legitimacy of her continued involvement. They argued that the process by which Justice Nyako exited the case was a “judicial event” and that her return to the case lacked jurisdiction.
In response to these disputes, Justice Nyako adjourned the trial indefinitely to allow for the resolution of the jurisdictional issues raised by the defense.
