The UK Home Office has updated its “Good Character” guidance, effective from February 10, 2025, stipulating that individuals who enter the UK illegally, including those arriving via small boats or concealed in lorries, will typically be denied British citizenship. This policy applies regardless of when the individual arrived in the UK.
The guidance specifies that applicants who have entered the UK illegally, particularly through dangerous journeys, will “normally” have their citizenship applications refused. This move is part of the government’s broader strategy to deter illegal immigration and reinforce border security.
Critics, including the Refugee Council and various legal experts, argue that this policy could hinder the integration of refugees and may contravene international conventions. They contend that it unfairly penalizes individuals who have been granted refugee status and are seeking to become contributing members of British society.
The Home Office maintains that the updated guidance strengthens existing measures to address illegal entry into the UK. A spokesperson stated, “There are already rules that can prevent those arriving illegally from gaining citizenship. This guidance further strengthens measures to make it clear that anyone who enters the UK illegally, including small boat arrivals, faces having a British citizenship application refused.”
