Abuja School Liable: N100m Damages for Student’s Death

​A Federal Capital Territory (FCT) High Court in Abuja has ordered Louisville Girls Secondary School, Gwagwalada, to pay N100 million in general damages for negligence leading to the death of nine-year-old student Kamzie Ikpeatusim.

Kamzie was admitted as a boarding student in September 2017 and fell seriously ill by October 2 of that year. Her father, Ifeanyi Ikpeatusim, filed a lawsuit (marked CV/1738/18) alleging that the school’s failure to provide prompt and adequate medical care resulted in her untimely death.

Justice Sylvanus Oriji, presiding over the case, ruled that the school breached its duty of care. He stated, “The claimant established his allegations of negligence against the school. There is no amount of money that can bring back the child to life.”

In addition to the N100 million in general damages, the court awarded N300,000 to cover the cost of the suit and imposed a 10% interest on the judgment sum from April 8 until full payment is made.

The court acknowledged that, following the incident, the school improved its medical facilities by ensuring doctors are available to attend to students twice daily. Justice Oriji noted that this enhancement serves as a tribute to Kamzie’s memory
