Rivers Government on Fubara: Misconduct Notice Unaddressed

​The Rivers State House of Assembly has initiated impeachment proceedings against Governor Siminalayi Fubara and his deputy, Professor Ngozi Odu, citing allegations of gross misconduct. On March 14, 2025, 26 members of the Assembly signed a notice detailing these allegations, which was subsequently addressed to the Speaker, Martin Amaewhule.

The notice accuses Governor Fubara of several constitutional breaches, including:​

  • Failure to present the 2024 Appropriation Bill to the Assembly, violating Section 121(1)(2) of the Nigerian Constitution.
  • Unauthorized expenditure of public funds, contravening Sections 120, 121(1)(2), and 122 of the Constitution.
  • Obstructing the Assembly’s functions, hindering its constitutional duties.
  • Appointing officials without the Assembly’s confirmation, bypassing constitutional requirements.​
  • Withholding salaries and allowances of Assembly members and the Clerk, against Section 121(3) of the Constitution.

In response, the Rivers State Government, through Commissioner for Information and Communications, Werisenibo Joseph Johnson, has downplayed the impeachment move, stating that the notice of misconduct was not directly addressed to Governor Fubara. Johnson expressed concerns about the Assembly’s approach, suggesting that it could lead to a constitutional crisis and emphasizing the need for adherence to due process.

The situation has heightened political tensions in Rivers State, with legal experts warning of potential constitutional implications if proper procedures are not followed. The outcome of these proceedings remains uncertain as the state navigates this complex political landscape.
