On February 19, 2025, the U.S. Court of Appeals for the Ninth Circuit denied President Donald Trump’s emergency request to lift a nationwide injunction blocking his executive order aimed at restricting birthright citizenship.
This executive order, signed on January 20, 2025, sought to deny citizenship to children born in the U.S. whose parents are neither citizens nor lawful permanent residents. The Ninth Circuit’s decision maintains the status quo, preventing the order’s implementation while legal challenges proceed.
The executive order has faced multiple legal challenges across the country. In addition to the case in the Ninth Circuit, federal judges in Maryland, Massachusetts, and New Hampshire have also issued injunctions blocking the order. These courts have cited concerns over the order’s constitutionality, particularly regarding its interpretation of the 14th Amendment’s Citizenship Clause.
Legal experts anticipate that the issue may ultimately be resolved by the U.S. Supreme Court, given the significant constitutional questions involved. For now, the appellate court’s ruling ensures that birthright citizenship remains in effect as litigation continues.
