Surrogacy Victory: Parents Use Son’s Frozen Sperm
A couple in India recently won a landmark legal battle allowing them to use their deceased son’s sperm for surrogacy.
After their son, Preet Inder Singh, passed away from Non-Hodgkin’s Lymphoma in 2020, the parents sought to retrieve his sperm, which had been frozen before chemotherapy.
The hospital initially refused to release the sperm, prompting a four-year legal struggle.
In a recent ruling, the Delhi High Court granted the couple access to the sperm, citing that Indian law does not prohibit posthumous reproduction if consent is given.
The couple plans to use the sperm for surrogacy, with a relative volunteering as the surrogate. This decision was driven by their wish to preserve their son’s legacy and continue the family line.
