Supreme Court Mandates Release of Foreign Aid Funds

Supreme Court Directs Unfreezing of Foreign Assistance Funds

The U.S. Supreme Court has ruled that the Trump administration must release nearly $2 billion in foreign assistance funds that had been previously frozen. This decision upholds a lower court’s order and mandates that the U.S. Agency for International Development (USAID) disburse the funds to nonprofit organizations and contractors for work already completed.

The Court’s 5-4 decision came after the administration’s request to maintain the freeze was denied. Justice Samuel Alito, joined by Justices Clarence Thomas, Neil Gorsuch, and Brett Kavanaugh, dissented, expressing surprise at the ruling and concern over potential financial implications.

This ruling addresses the legal challenge against the Trump administration’s executive order that had paused foreign assistance payments, affecting various global programs. The Court’s decision underscores the requirement for the administration to adhere to congressional appropriations and ensure that funds are utilized for their intended purposes.
