Allegations of Bias: Emefiele’s Request for Recusal

Former Central Bank of Nigeria (CBN) Governor, Godwin Emefiele, has requested that Justice Rahman Oshodi of the Special Offences Court in Ikeja, Lagos, recuse himself from his ongoing trial, citing concerns of judicial bias. Emefiele faces 19 charges, including abuse of office and corruption, brought against him by the Economic and Financial Crimes Commission (EFCC).

During the proceedings on February 24, 2025, Emefiele’s counsel, Olalekan Ojo (SAN), objected to the judge permitting a leading question during the examination-in-chief of the seventh prosecution witness, Adetola John. Despite the defense’s objection, the court allowed the question, leading Ojo to assert that the judge’s actions indicated potential bias. Consequently, the defense declined to cross-examine the witness and formally requested Justice Oshodi’s recusal from the case.

In response, EFCC’s lead counsel, Rotimi Oyedepo (SAN), opposed the recusal application, arguing that the court had previously ruled against the prosecution on multiple occasions, demonstrating impartiality. Oyedepo characterized the defense’s motion as a delay tactic and urged the court to proceed with the trial.

Justice Oshodi has adjourned the case until Wednesday, February 26, 2025, to deliver a ruling on the recusal application. This decision will determine whether the current court will continue to preside over Emefiele’s trial or if a new judge will be assigned to the case.
